Welcome to FitStory. The terms "we", "us" and "our" refer to FitStory, a brand operated by LEMONBYTE LLP (GSTIN 30AAMFL1709R1Z1), a limited liability partnership registered in Goa, India.
We operate this store and website at fitstory.shop, including all related information, content, features, tools, products and services (the "Services"). FitStory is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced here (these "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
Nothing in these Terms limits or excludes any right you have under the Consumer Protection Act, 2019 or any other law of India that cannot be contracted out of.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years of age, or that you are accessing the Services under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
To use the Services — including browsing our store or purchasing any product — you may be asked to provide certain information such as your email address, billing, payment and shipping details. You confirm that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.
SECTION 2 — OUR PRODUCTS
We make every effort to represent our products accurately. However, colours, finish and appearance may differ from how they appear on your screen depending on your device and its display settings.
We do not warrant that the appearance of any product will be identical to how it is depicted in our store.
Product descriptions are subject to change at any time at our discretion. We reserve the right to discontinue any product, and to limit the quantities we offer to any person, address, region or jurisdiction on a case-by-case basis.
2.1 Product-specific notices
Odour Remover. Our Odour Remover is a stainless steel household article. It is intended for use on hands to reduce food-related odours. It is not a soap, a cosmetic, a disinfectant, an antibacterial product, or a substitute for washing your hands with soap and water where hygiene requires it.
Magnetic Nasal Dilator. Our Magnetic Nasal Dilator is a general wellness and comfort accessory intended to support easier nasal breathing. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or condition, including obstructive sleep apnoea, chronic snoring, sinusitis or any respiratory disorder. It is not a substitute for medical advice, diagnosis or treatment. If you experience persistent snoring, disrupted breathing during sleep, or any nasal or respiratory symptoms, please consult a qualified medical practitioner. Do not use if you have a pacemaker, implanted defibrillator or other implanted electronic medical device, or any known sensitivity to nickel or the materials used. Discontinue use and seek medical advice if you experience irritation, pain, bleeding or discomfort.
General. Keep all products away from children under 3 years of age. Products containing small parts or magnets present a choking and ingestion hazard. Ingested magnets can cause serious internal injury and require immediate medical attention.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted.
Please review your order carefully before submitting. If we do not accept, change or cancel an order, we will attempt to notify you using the email address or phone number provided at the time of the order, and any amount already paid will be refunded in full.
Your purchases are subject to return, replacement or refund solely in accordance with our Returns & Refunds Policy, which forms part of these Terms.
You confirm that your purchases are for your own personal or household use, and not for commercial resale, redistribution or export.
SECTION 4 — PRICES, TAXES AND PAYMENT
All prices are listed in Indian Rupees (INR).
All prices displayed are the Maximum Retail Price and are inclusive of all applicable taxes, including GST. No additional tax will be added at checkout.
We currently offer free shipping across India on all orders, with no minimum order value. If this changes, any shipping charge will be shown separately and clearly before you complete your order.
We accept prepaid orders only. Payment may be made by UPI, credit card, debit card or net banking through our payment partner, Razorpay. We do not offer Cash on Delivery.
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation email.
We may run promotions from time to time governed by their own terms. Where those terms conflict with these Terms, the promotion terms will govern for that promotion.
You agree to provide current, complete and accurate payment and contact information for all purchases, and to update it promptly so that we can complete your transactions and contact you as needed.
You confirm that (i) the payment information you provide is true, correct and complete; (ii) you are authorised to use the payment method for the purchase; and (iii) you will pay all charges incurred at the posted prices.
We do not store your card or payment credentials. Payments are processed by Razorpay under their own terms and security standards.
SECTION 5 — SHIPPING AND DELIVERY
We ship across India through third-party courier partners.
All delivery timelines shown are estimates, not guarantees. We are not liable for delays caused by courier partners, weather, strikes, public holidays, remote or restricted pincodes, or other events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address and a reachable phone number. We are not responsible for orders that fail to deliver because of an incorrect or incomplete address supplied by you.
Risk of loss or damage in transit remains with us until the product is delivered to you. If your order arrives damaged, defective, incomplete or incorrect, you are covered by our Returns & Refunds Policy.
SECTION 6 — INTELLECTUAL PROPERTY
The Services — including all trademarks, brand elements, text, images, graphics, product photography, video, audio, and the design, selection and arrangement of them — are owned by LEMONBYTE LLP, its affiliates or its licensors, and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable Indian and international intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent.
Except as expressly stated here, nothing in these Terms grants you any licence or right under any patent, trademark, copyright or other intellectual property of LEMONBYTE LLP, Shopify or any third party. All rights not expressly granted are reserved.
"FitStory", the FitStory logo, and our product names, designs and taglines are trademarks or unregistered marks of LEMONBYTE LLP. You must not use them without our prior written permission. "Shopify" and the Shopify logo are trademarks of Shopify Inc. All other names and marks appearing on the Services belong to their respective owners.
SECTION 7 — OPTIONAL THIRD-PARTY TOOLS
You may be given access to third-party tools through the Services which we neither monitor nor control.
We provide access to such tools "as is" and "as available", without warranties, representations or conditions of any kind, and without endorsement. We have no liability arising from your use of optional third-party tools.
Any use of these tools is entirely at your own risk. You should review and satisfy yourself with the terms on which the relevant third-party provider offers them.
We may offer new features and tools through the Services in future. These will also form part of the Services and be subject to these Terms.
SECTION 8 — THIRD-PARTY LINKS
The Services may contain links or materials from third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party material or website.
If you leave the Services to access third-party sites, you do so at your own risk. We are not liable for any harm or loss arising from your access to third-party sites or your purchase or use of third-party products or services. Please review their policies before transacting with them, and direct any complaints about third-party products or services to that third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
FitStory is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with FitStory. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and FitStory, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with FitStory.
SECTION 10 — PRIVACY
All personal information we collect through the Services is handled in accordance with our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and other service providers who may be located outside India. Please review our Privacy Policy for details of how your personal information is used.
SECTION 11 — REVIEWS AND FEEDBACK
If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, photographs, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, sub-licensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use — for example, displaying a product review on our website or social media.
You confirm that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any compensation, free product or incentive received in connection with it; and (iii) your Feedback complies with these Terms.
We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.
We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful, offensive, defamatory, obscene, misleading or otherwise objectionable, or that infringes any third party's rights.
You agree that your Feedback will not infringe any third party's copyright, trademark, privacy or personality rights, will not be defamatory, abusive or obscene, and will not contain any virus or malicious code. You may not use a false email address, impersonate another person, or mislead us or others about the origin of Feedback. You are solely responsible for your Feedback and its accuracy.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information in the Services containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability.
We reserve the right to correct any error, inaccuracy or omission, and to change or update information or cancel orders where any information was inaccurate, at any time and without prior notice — including after you have submitted your order. Where we cancel an order for this reason, any amount you have paid will be refunded in full.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly:
(a) for any unlawful or malicious purpose; (b) to violate any applicable law, rule or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, disparage or intimidate any person; (e) to transmit false or misleading information, including fraudulent orders, chargebacks or return claims; (f) to transmit any material that does not comply with these Terms; (g) to send any advertising or promotional material, junk mail or spam; (h) to impersonate any other person or entity; or (i) to engage in any conduct that restricts or inhibits anyone's use of the Services, or that may harm FitStory, Shopify or other users, or expose them to liability.
You further agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool, AI or agentic tool, or other automated means to access the Services except as permitted in Section 14; or (f) interfere with, bypass or circumvent any security or authorisation measure, robot exclusion header, or other measure we use to restrict access.
We reserve the right to suspend, disable or terminate your access at any time, without notice, if we determine you have breached any part of these Terms.
SECTION 14 — AUTOMATED AGENTS
14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed without direct supervision.
14.2 No Agent may access, use or interact with the Services unless it identifies itself and operates in strict accordance with Section 14.4. No Agent may access the Services if we have asked it to refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.
14.4 Agents must: (i) identify in all HTTP/HTTPS requests that the request comes from an Agent, by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that access is from an Agent, including by mimicking human interaction patterns or by completing or circumventing CAPTCHAs; (iii) respond truthfully to any prompt seeking to determine whether interactions come from a human; and (iv) not circumvent any measure intended to block, limit or control Agent access.
SECTION 15 — TERMINATION
We may terminate this agreement or your access to the Services (or any part of them) at our discretion at any time without notice. You remain liable for all amounts due up to and including the date of termination.
The following sections survive termination: Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Jurisdiction, Privacy, and any other provision that by its nature should survive.
SECTION 16 — DISCLAIMER OF WARRANTIES
Information presented through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY US, AND EXCEPT FOR ANY RIGHTS YOU HAVE UNDER INDIAN CONSUMER LAW THAT CANNOT BE EXCLUDED, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE OR NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, AND SUBJECT TO ANY RIGHTS YOU HAVE UNDER INDIAN CONSUMER LAW THAT CANNOT BE EXCLUDED, IN NO EVENT SHALL LEMONBYTE LLP, ITS PARTNERS, DESIGNATED PARTNERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM.
WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU IN CONNECTION WITH ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend and hold harmless LEMONBYTE LLP, Shopify, and our respective affiliates, partners, officers, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms or any policy incorporated by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced. We may control the defence and settlement of any such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, which shall not be unreasonably withheld. You will cooperate in the defence of indemnified claims.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. This will not affect the validity or enforceability of the remaining provisions.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with any policies posted on our website, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements, communications or proposals, whether oral or written, including any prior version of these Terms.
Any ambiguity in these Terms shall not be construed against the drafting party.
SECTION 21 — ASSIGNMENT
You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.
SECTION 22 — GOVERNING LAW AND JURISDICTION
These Terms and any separate agreements under which we provide Services to you are governed by and construed in accordance with the laws of India.
Subject to your rights under the Consumer Protection Act, 2019 — which permit you to approach the consumer forum having jurisdiction where you reside or work — you and we agree that the courts at Margao, Goa, India shall have exclusive jurisdiction over any dispute arising out of these Terms.

The Grievance Officer will acknowledge receipt of any complaint within 48 hours and resolve it within 30 days of receipt.

We will notify you of any material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
